1. Introduction

These Terms and Conditions govern the provision of English coaching services by Christopher Mason, trading as Clear English Coaching ("we", "us", or "our"). By purchasing services or booking a session, you agree to these Terms and Conditions.

2. Nature of the service and responsibility

Clear English Coaching provides one-to-one English coaching sessions focused on improving communication in professional contexts. Sessions are delivered online and tailored to the client's needs.

Coaching is designed to support improvement in communication, but outcomes will vary depending on individual effort and circumstances. While reasonable care and skill are exercised, no specific results are guaranteed.

Clients remain responsible for how they apply coaching guidance in their own workplace, and for any decisions, actions, or outcomes that result.

Coaching sessions are delivered using appropriate tools, which may include note-taking and feedback tools to support the service.

Sessions are not recorded by default. If a session is to be recorded, this will only be done with your prior consent and for a specific agreed purpose (for example, review or feedback). You can decline or withdraw consent at any time.

Any information shared during coaching sessions will be treated as confidential and used only for the purpose of delivering the service.

Coaching support is provided within scheduled sessions. Communication outside sessions is limited and handled at our discretion.

Services are intended for individuals aged 18 years and over. By booking or purchasing a session, you confirm that you are at least 18 years old.

To the fullest extent permitted by law, Clear English Coaching is not liable for any indirect or consequential loss arising from the use of the services.

3. Payments

All payments are processed securely via Stripe. Prices on this website are shown in British Pounds (GBP). Where available, Stripe may offer you the option to view and pay in your local currency at checkout. Any local currency amount and available payment methods will be shown by Stripe before you pay. Currency conversion, where applicable, is handled by Stripe or your payment provider.

4. Refunds, Cancellations, Session Validity, Expiry and Service Completion

4.1 Refunds

There is a 14-day cooling-off period from the date of purchase, during which you have the right to cancel your purchase for a full refund, provided no coaching sessions have been used.

If you expressly ask us to begin coaching within this period and later request a refund, you agree that any sessions already delivered, or scheduled to begin within 24 hours of your cancellation request, will be deducted from your refund. For session packages, these will be charged at the standard single-session rate, and the remaining balance will be refunded.

Refunds will be processed through the original payment method used for the purchase. Where a payment was made in a local currency through Stripe, any refund will be subject to Stripe's currency conversion and refund rules.

After the 14-day cooling-off period, purchases are non-refundable, except where required under applicable consumer protection laws.

4.2 Cancellations and rescheduling

If you need to reschedule a session, you may do so by emailing chris@clearenglishcoaching.com with at least 24 hours' notice. Requests made with less than 24 hours' notice will be treated as a late cancellation and may result in the session being forfeited and counted as used.

If Clear English Coaching needs to reschedule a session with less than 24 hours' notice, reasonable efforts will be made to arrange a mutually convenient alternative. If rescheduling cannot be agreed, the session will not be counted as used, and a refund will be provided. For session packages, refunds are calculated based on the per-session package rate. The standard single-session rate is the current price listed on the website for a single, individual coaching session.

If you do not attend a scheduled session without prior notice, the session will be treated as a late cancellation and counted as used. This also applies where you are unable to join due to technical issues on your side.

If Clear English Coaching is unable to attend a scheduled session without prior notice, reasonable efforts will be made to reschedule at a mutually convenient time. If rescheduling cannot be agreed, the session will not be counted as used and a refund will be provided. For session packages, refunds are calculated based on the per-session package rate. The standard single-session rate is the current price listed on the website for a single, individual coaching session.

4.3 Session validity

If you join a session late, the session will still finish at the scheduled end time to avoid impacting other bookings. Any missed time will not be made up or added to future sessions. Sessions are based on the scheduled time rather than the time attended.

If Clear English Coaching joins a session late, reasonable efforts will be made to make up any lost time during the session or at a mutually agreed time.

If a session is disrupted due to technical issues, reasonable efforts will be made to continue the session. If a session cannot reasonably continue due to ongoing technical issues, it may be rescheduled where appropriate. Where the issue originates on your side, any time lost will not normally be recoverable. Where the issue originates on our side, any lost time will be made up at a mutually agreed time.

4.4 Session expiry and service completion

All services, including individual sessions and session packages, are valid for 12 months from the date of purchase. This helps ensure consistent progress and availability. Any unused sessions after this period will expire and will not be eligible for a refund.

The service is considered fully delivered once a session has been completed, or, where a package is purchased, once all sessions in the package have been completed. After this point, no further services or refunds will be provided, except where required by law.

5. Conduct and Fair Use

Coaching is provided in a professional and respectful environment. If a client behaves in a way that is inappropriate, offensive, or disruptive (including, but not limited to, harassment, hate speech, or explicit content), Clear English Coaching reserves the right to end a session or discontinue the service. In such cases, no refund will be provided for the session in question nor any remaining sessions.

Misuse of the booking system, contact form, or any attempts to disrupt or interfere with the service is not permitted. Clear English Coaching reserves the right to refuse or discontinue service where necessary.

6. Use of Materials and Recordings

Any materials, frameworks, or content provided during coaching sessions are for your personal use only and may not be shared, reproduced, or distributed without prior written permission.

Sessions and recordings may not be recorded, shared, or published without prior agreement. This includes posting content online, on social media, or sharing with third parties.

7. Limitation of Liability

To the fullest extent permitted by law, Clear English Coaching's liability for any claims arising from the provision of services is limited to the amount paid by the client for those services.

Nothing in these Terms limits any liability that cannot be excluded under applicable law.

8. Time Limitation on Claims

Any claims relating to the services provided must be brought within 12 months of the relevant service being delivered.

9. Third-Party Services

This website and service may use third-party services, including payment providers and scheduling tools. Clear English Coaching is not responsible for the content, policies, or practices of these third-party services.

10. Dispute Resolution

If a dispute arises, both parties agree to try to resolve it through informal discussion in the first instance.

If a resolution cannot be reached, disputes may be referred to arbitration in the United Kingdom. Arbitration will take place in Chester, England, and will be conducted in English.

11. Updates to These Terms

These Terms and Conditions may be updated from time to time. Updates will be published on this page, and the "last updated" date will be revised accordingly. Where appropriate, active clients may also be notified directly.

12. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.
